Conditions of Car Use
DEFINITIONS
Owner
The owner of the vehicle supplied is shown on the certificate of immatriculation.
Principle Guest
Is the guest nominated and declared as the first guest on the booking form.
Partner
Is defined as the person staying with and booked in with the principle guest.
Car
The car designated to the principle guest on arrival.
Eligibility to Drive
Provided that the principle guest and partner comply with the following conditions the nominated car will be provided with fully comprehensive insurance (with excess as shown below) and full breakdown recovery service. The principle guest must sign this agreement and persons using the car during your stay must hold a full EU driving licence (for the Fiat a manual licence), must be over 30 years old and have held a full driving licence for at least five years.
Limits of Use
Free use of the car limited to an average 150 Km/100 ml per day, during your stay. For example a 3 night stay entitles you to 450 Km/300 ml free driving. Usage beyond this will be charged at a rate of £1.50 per ml for the Fiat and £1.50 per km for the Mercedes.
Liability responsibility
The principle guest will be responsible for full reimbursement for any damage caused to the vehicle that is not covered by insurance. There is an excess of £1000 on each vehicle. The principle guest will be responsible for any fines and parking tickets collected whilst the vehicle is in their care.
Anybody intending to use the vehicle will be asked to show their driving licence (both parts) and passport for verification and for copy prior to driving the vehicle and the principle guest will be asked for a credit (not debit) card imprint as a deposit, and this agreement must be signed by the principle guest. Our insurers insist that we take a digital photo of anybody who will drive one of our cars.
In addition, anybody intending to drive the car must never have been refused motor insurance, had special conditions imposed as a result of a claim, or had motor insurance cancelled by an insurer at any time. If any intended driver has had a conviction resulting in suspension, endorsement or a single conviction resulting in more than 3 penalty points being issued within the last 3 years this must be disclosed to the owners and it is at the discretion of the owners’ insurers whether or not the person is allowed to drive the car.
If any proposed driver has had more than 1 accident in the previous 3 years, this must be declared and it is at the owners’ insurers discretion whether or not that person can drive the car.
Driving under the influence of either drink or drugs is absolutely forbidden. You will not be insured if you do so, and remember the drink driving limits in France are lower than in the UK.
In case of accident
In the unfortunate even that you are involved in an accident, you MUST complete an accident report for, signed by all parties, and report the accident immediately to us. If a vehicle is immobilised, anybody is injured or there is damage to public property, the Gendarmes (Police) must also be notified before you leave the scene of the accident (Tel 17 from any French landline or mobile, 0033 17 from UK mobile). Failure to do the above will make the principle guest fully responsible for all costs (including 3rd parties).
Breakdown
Breakdown cover is provided during your stay, the number to contact is within your drivers pack.
Drivers Pack
The drivers pack includes insurance details (including an accident report form and insurance certificate), the control technique and the certificate of immatriculation. This, together with the driving licence and passport of the driver must be carried in the car whilst being driven, but must not be left in the car when parked.
We will charge the principle guest for any documents or keys mislaid whilst the vehicle is under their responsibility.
The principle guest is ultimately held responsible for taking care of the vehicle during the dates of agreement. This includes ensuring that the car is driven within the law and in a way appropriate to the road conditions at any point in time. The car must be locked when unattended and all documents removed. Appropriate additional security items provided must be used, when the vehicle is left unattended, even if the convertible hood is raised.
Vehicle Condition Report
A vehicle condition report will be completed and signed by the owner and principle guest (including photographs where appropriate) prior to release of the vehicle. Any damage or breakage not included within this report is the responsibility of the principle guest).
Limits to Use
The vehicle must be used for social, domestic and pleasure use only. The vehicle must not be taken off road or used for racing, pacemaking or track days or any form of competition, tuition or hire. The car must not be taken out of mainland France, and must return to the owner’s residence every night except by prior written agreement.
Fuel
Your car will be supplied with a full tank of fuel, you must use the type of fuel stated by the owner during your break and return the car with a full tank. If not the principle guest will be charged for re fuelling at current fuel rates plus £30.
Oil and Water
Fluid levels will be checked and topped up by the owner each evening (except fuel), but it is the principle guests responsibility to ensure these are maintained at the correct level during the day, and checked at least once a day if the car is not being returned to the owner residence. The principle guest is responsible if a vehicle fails through lack of fuel, oil, water or break fluid.
Materials Supplied
All materials supplied with the car, including first aid kits, safety equipment, security equipment, covers, hoods, maps, spare parts and tools must be returned in full and undamaged with the vehicle at the end of your break. A charge will apply for damaged or missing accessories.
Personal Effects
The owner is not responsible for any personal effects left or carried within the car or left at the owner’s property during your break.
Smoking and Pets
For the consideration of other guests, smoking and pets are not permitted in our cars or accommodation.
Legal Fees
The principle guest will be responsible for all owners’ legal fees as a direct result of the guest use of the vehicle during this period.
Should the vehicle remain unusable after the duration of the principle guests' stay due to physical or mechanical damage deemed by the owner to be the fault of the principle guest, the owner reserves the right to charge the principle guest for any lost revenue or compensation due to the unavailability of the car, or to full costs or supply a replacement for the period in which the vehicle is out of service.
Mechanical Damage
Payment for mechanical damage not covered by insurance (tyres, wheels, engine, gearbox, clutch etc) due to misuse or abuse during your stay will be the responsibility of the principle guest (this does not include normal wear and tear) and for any costs involved in recovering property.
Miscellaneous
It is the principle guest’s responsibility to ensure they are familiar with the controls and workings of the vehicle before they or their partners use it. We will provide a detailed run through of the vehicle on your arrival.
It is the driver’s responsibility to be aware of and abide by all French highway regulations at all times. Cars are equipped with warning triangles and visibility jackets (both legal requirements in France) and maps. These must remain in the car at all times.
Whilst we make every possible effort to ensure your vehicle is in the 1st class condition in the unfortunate event of a breakdown, we reserve the right to supply an alternative classic car.
Should there be any evidence or suspicion of abuse or neglect of the car or contravention of this agreement, we withhold the right to withdraw vehicle immediately without compensation or replacement.
